What to Expect at an ALJ Hearing

An ALJ hearing is more informal than a court trial but follows a structured process. It typically occurs within 75 miles of your home and lasts about an hour. During the hearing, you will be asked to testify about your disability and how it affects your ability to work. Witnesses, such as medical or vocational experts, may also be called to provide additional insight into your case.

How We Prepare for Your Hearing

Step 1: Pre-Hearing Preparation We begin by thoroughly reviewing your case file, including all previous application materials and decisions. We then gather additional evidence that may not have been considered initially, such as updated medical records, new expert opinions, and testimonies from your treating physicians.

Step 2: Strategic Case Building Our experienced attorneys develop a strategy based on the specifics of your case, identifying key issues to address and potential weaknesses in the SSA’s arguments. We prepare you for the types of questions the ALJ might ask and coach you on how to provide clear, effective answers.

Step 3: At the Hearing On the day of the hearing, we represent you and handle all aspects of the legal proceedings. We present opening and closing statements, examine and cross-examine witnesses, and ensure that all relevant evidence is considered. Our aim is to highlight the severity of your disability and its impact on your life and employment.

Step 4: Post-Hearing Follow-up After the hearing, we remain in contact with the ALJ’s office to monitor the progress of your case and prepare for any additional steps if the decision is unfavorable.
