Liver Disease Disability Benefits

Liver Disease Disability

Can I Get Disability for Liver Disease?

Yes — Listing 5.05 covers chronic liver disease. Approval depends on objective findings: documented complications like ascites, esophageal varices, hepatic encephalopathy, or specific lab abnormalities. Building this record carefully is essential.

THE PROBLEM

Why These Claims Get Denied

The same five mistakes sink the majority of pro-se applications. Most denials aren't because the conditions aren't real — they're because the record doesn't show what SSA needs to see.

Complications not documented

Listing 5.05 requires specific complications — varices, ascites, encephalopathy, SBP. Diagnosis of cirrhosis alone isn't enough.

No hepatologist or GI involvement

Liver claims need specialist documentation. Primary care management is rarely sufficient for listing-level severity.

Alcohol component complicates claims

SSA evaluates whether substance use is material to disability. Documented sobriety with continued liver disease strengthens claims significantly.

Treatment compliance gaps

Lactulose, rifaximin, diuretics — non-adherence can be used against claims. Document medical reasons for any changes.

Wrong 5.05 sub-criteria

5.05A through 5.05G cover different findings. Pro-se applicants often miss which path their evidence supports.

WHO QUALIFIES

Liver Conditions That Can Qualify

Many forms of chronic liver disease qualify under Listing 5.05. These are the conditions we most commonly document in successful cases.

Cirrhosis (All Causes)

End-stage liver scarring. Alcoholic, viral, NAFLD/NASH, autoimmune, primary biliary cholangitis.

Hepatitis C with Cirrhosis

Despite DAA treatment availability, established cirrhosis remains qualifying.

Hepatitis B Cirrhosis

Active or post-treatment hepatitis B with established cirrhosis.

Alcoholic Liver Disease

Including alcoholic hepatitis and alcoholic cirrhosis with documented sobriety.

Non-Alcoholic Steatohepatitis (NASH)

Progressive fatty liver with inflammation leading to cirrhosis.

Primary Biliary Cholangitis

Autoimmune destruction of small bile ducts. Often slowly progressive.

Primary Sclerosing Cholangitis

Chronic inflammation of bile ducts. Often associated with IBD.

Autoimmune Hepatitis

Immune-mediated liver inflammation requiring chronic immunosuppression.

End-Stage Liver Disease (ESLD)

MELD score 15+, transplant evaluation, or post-transplant status.

BUILD THE RECORD

Medical Evidence SSA Wants to See

Winning these cases is built on documentation. These are the five pieces of evidence that actually move the needle.

1

Hepatology / GI Treatment Records

Established care with hepatology or gastroenterology for at least 12 months. MELD score calculations, Child-Pugh classification, treatment progression.
2

Documented Complications

Esophageal varices on endoscopy (with bleeding history if applicable), ascites requiring paracentesis, hepatic encephalopathy episodes, SBP (spontaneous bacterial peritonitis), hepatorenal syndrome.
3

Laboratory Evidence

Bilirubin, INR/PT, albumin, AST/ALT, platelet count trended over time. Hepatitis serologies, autoimmune markers, ferritin/iron studies as appropriate.
4

Imaging Studies

Abdominal ultrasound, CT, or MRI showing cirrhosis features, splenomegaly, ascites, varices, and liver mass screening.
5

Hospitalization History

ICU admissions for variceal bleeding, encephalopathy, SBP, or hepatorenal syndrome. Each documented hospitalization strengthens severity.
TREATMENT HISTORY

Liver Disease Treatments SSA Wants Documented

SSA expects to see appropriate disease-specific treatment, complication management, and where indicated, transplant evaluation.

THE TECHNICAL KEY

SSA evaluates liver disease under Listing 5.05 — seven paths.

Listing 5.05 has seven sub-criteria. Any one of them can satisfy the listing. The right path depends on which complications you've documented:

015.05A: Hemorrhaging from varices or ulceration requiring transfusion or shock
025.05B: Ascites or hydrothorax on two evaluations 60 days apart with specific lab abnormalities
035.05C: Spontaneous bacterial peritonitis with peritoneal fluid containing 250+ neutrophils
045.05D-G: Hepatic encephalopathy, hepatorenal syndrome, hepatopulmonary syndrome, end-stage liver disease

Documented complications matter more than the underlying diagnosis. We help build records that specifically address Listing 5.05's evidentiary requirements.

OUR APPROACH

How Desert Disability Wins These Claims

We don't just submit paperwork. We build the record SSA actually needs to see.

01
Strategy 01

Customized Medical Source Statements

We draft and send targeted questionnaires to your treating specialists that ask the exact questions SSA wants answered, in the language SSA uses. Generic notes rarely win disability claims. A properly-completed MSS often does.

02
Strategy 02

Symptom Journal Coaching

We instruct clients on what to log, how to log it, and how to make the journal credible evidence at hearing. There is a right way and a wrong way to do this, and the difference matters.

03
Strategy 03

Treatment Strategy Review

We help you understand whether you've tried enough treatments, whether you should pursue additional therapies before your hearing, and how to document compliance with provider recommendations.

04
Strategy 04

Hearing Preparation

We prepare you for the Administrative Law Judge hearing — the specific questions you'll face about frequency, intensity, recovery time, and functional impact. Coming in unprepared loses cases.

05
Strategy 05

Vocational Expert Cross-Examination

At the hearing, a vocational expert will testify about jobs you can supposedly still perform. We know how to cross-examine them on how your specific limitations eliminate every job they propose.

THE STATISTICS

Approval Rates by Stage

SSA approval data shows why having an attorney at the hearing level matters. Most claims that win do so at the Administrative Law Judge stage.

YOUR ACTION PLAN

What to Do Right Now

Whether or not you decide to work with us, these are the steps that strengthen any disability claim. Start today.

1

See a Specialist

If you haven't already, this is the single most important step. Treatment by the right kind of specialist for 6-12 months before filing dramatically improves your odds.

2

Start a Symptom Journal Today

Log date, severity 1-10, duration, triggers, medications taken, and functional impact. Even reconstructing the last 30 days from memory is valuable evidence.

3

Request Your Medical Records

Every specialist visit, ER visit, and imaging study. You're entitled to these by federal law (HIPAA). Most providers can send them digitally within 30 days.

4

Pull Your Prescription History

Your pharmacy can print a complete list of medications going back years. This is one of the strongest pieces of treatment-trial evidence available.

5

Don't Wait to File

You can lose months of retroactive backpay by delaying. SSDI backpay can be paid up to one year before the application date — but only if you file promptly.

6

Don't Stop Treatment After a Denial

Appeals often succeed where initial claims fail — but only if treatment continues uninterrupted. Gaps in care during the appeal process are used against you.

ANSWERS

Frequently Asked Questions

Not automatically. SSA evaluates whether substance use is "material" to disability. Documented sobriety (6+ months) with continued liver disease strengthens claims significantly. Active drinking complicates them but doesn't disqualify.

Yes. End-stage liver disease awaiting transplant typically qualifies. Post-transplant status qualifies for at least one year after transplant under SSA rules.

No — many other complications qualify. Documented ascites, encephalopathy, SBP, hepatorenal syndrome, or specific lab abnormalities can satisfy Listing 5.05 without a bleeding history.

Yes. SVR (sustained virologic response) doesn't reverse established cirrhosis. The structural liver damage and complications can still qualify under Listing 5.05.

MELD doesn't appear in Listing 5.05 directly, but it's used in 5.05G for end-stage liver disease (MELD 22+ on two occasions). It also correlates with transplant priority and overall severity.

Simple steatosis usually doesn't qualify, but NASH with cirrhosis or fibrosis can. The disease progression and complications matter, not the underlying cause.

Liver cancer is evaluated separately under Listing 13.19 (malignant neoplastic diseases). Some forms qualify automatically. Combined with underlying cirrhosis often produces strong claims.
