SSDI INELIGIBLE

You may only be eligible for Supplemental Security Income

Based on your response, it appears you may not be eligible for Social Security Disability Insurance ("SSDI") because you do not have enough work credits on your record.

As a person works and pays taxes, part of their taxes goes into Social Security. To be eligible for SSDI benefits, a taxpayer must prove that their disability began prior to their date of last insurance.

If you are not eligible for SSDI benefits, you may still qualify for disability benefits under Supplemental Security Income ("SSI").

Your condition must be diagnosed

Recommendation: Apply On Your Own and Work on Getting a Diagnosis

It is unlikely you will get approved for disability without a firm diagnosis from a doctor. While you can still apply for disability now, it is recommended that you work on obtaining a formal diagnosis for your primary disabling medical condition as quickly as possible.

How to File for Social Security Disability

Download our screen-by-screen guide on how to file for an initial application for Social Security Disability benefits all on your own over the internet.

This eGuide is Our Gift to You

Normally, this guide is available for Amazon for $14.99. However, as a token of our appreciation for contacting Desert Disability regarding your claim, it is being provided to you as a complimentary gift by Mr. Herman. We ask that you not share it with others without our permission.

Don't Hesitate to Contact Us If You are Denied

While we are hopeful you will get approved on first review, please be mindful that most claims are initially denied. The most important part is to get the process started by completing the initial application. If you are denied, don't worry! We would be happy to review your case further and help you on appeal.

Your Condition May Not Be “Severe”

The law requires that the disabling medical condition must last 12 consecutive months.

To be approved for Social Security Disability benefits, the law requires that your disabling medical condition must be so ”severe” that it prevents you from engaging in “substantial gainful activity” for at least 12 consecutive months.

Since your condition is expected to improve within 12 months, you would not be eligible for Social Security Disability Insurance benefits.

Based on your response, it appears that your condition is expected to improve within 12 months. As such, you may wish to explore short-term disability or long-term disability with your previous employer.

Contact us anytime for a claim assessment.

If there are any complications that arise during your treatment or if your condition declines, you may become eligible for Social Security Disability. Please do not hesitate to contact us in the future if you feel your medical condition has lasted or is expected to last for 12 consecutive months preventing you from working.
