DISABILITY CLAIM EVALUATION

SSA Uses a 5 Step Analysis to Evaluate Social Security Disability Claims

The 5-step analysis is “sequential”, meaning each step is reviewed in order . If a claimant does not pass a step, the evaluation stops and the claimant is denied.

Step 1

Has the claimant stopped engaging in “Substantial Gainful Activity?”

Step 2

Does the claimant have a severely diagnosed medical condition?

Step 3

Does the claimant’s medical condition meet or equal a listing?

Step 4

Can the claimant return to any their past work?

Step 5

If the claimant is UNDER 50:

Can the claimant work any other job?

If the claimant is 50 OR OLDER:

Does the claimant have any skills that would transfer to other work with minimum adjustment?

Why You Should Consider Hiring an Attorney

The disability claim evaluation process is complex and mistakes can be unforgiving. It is strongly encouraged to hire an attorney with experience and knowledge who can navigate the filing and appeal process. Most importantly, your attorney can forecast what is needed to put you in the best position to win your claim.
